Abstract:

This publication, the first in a series of issue papers as part of the Centers for Arts and Culture Art, Culture and the National Agenda project, provides an overview, historical analysis, and discourse on the legal implications of copyright law for the creative sector and cultural organizations.

Written by the former counsel for the National Endowment for the Humanities, the paper examines and explains U.S. Copyright laws in plain language and points out areas of increasing concern and importance to organizations, artists, and other creative people. The author also makes recommendations for policymakers. The most critical of these proposals is to monitor current legal and technological developments so that any content preferences or restrictions are not added to the law, undermining individual creative freedom.
